Externalities could perhaps be dealt with under a judicial system in that the judicial body could hear a case put by someone who felt something was an externality and they could decide whether it was or not and whether waiting would be prudent or whether to allow claims of property rights on this new resource. It would be essential that this body would be subject to heavy penalties if it attempted to go further than this role.

The animals act is similar, people would own the animals and compensation would have to be paid if anyone shot them, similarly if the animals did any damage then the owners would be liable.Presumably they would be owned by people wishing to preserve them in the case of badgers and people that want to farm them in the case of deer.
The Clean air act requires the same for the atmosphere. Ownership of the oceans and rivers would stop over pollution that does any damage, particularly if the wildlife is owned by someone, and thus there is penalty for destroying it. However the atmosphere cannot be fished and the pollution thereof does not directly kill anyone. Nevertheless ownership of it makes it easier to see who's polluting where and apportion costs if any.
